By creating an account or using theStick (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you and theStick, LLC (“we,” “us,” or “our”).
theStick is a mobile golf scoring, stat-tracking, and social betting ledger application. It allows users to record rounds, track scores and handicaps, organize friendly wagers with playing partners, and view live round updates.
Important: theStick is not a gambling operator, bookmaker, sportsbook, or casino. We do not accept wagers, hold funds, or facilitate payments of any kind. Any monetary transactions related to golf bets occur entirely between users. theStick only records and displays agreed-upon outcomes between consenting players.
You must be at least 18 years old to use theStick. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms.
It is your sole responsibility to ensure that your use of theStick — including tracking friendly golf wagers, spectator Live Bets, and league pool events — complies with all applicable laws in your jurisdiction.
To access certain features you must create an account. You agree to provide accurate information and keep it up to date. You are responsible for all activity that occurs under your account and must keep your login credentials secure.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in abusive behavior toward other users.

Violations may result in immediate account termination without notice or refund.
theStick provides tools for friends to track private golf game results, including Wolf, Nassau, Skins, Banker, Hammer, Dots, and others. The app calculates amounts won or owed based on scores and bet structures entered by users.
Live Bets. Spectators viewing a round via a live-watch link may propose and accept additional wagers (“Live Bets”) about a player’s performance — e.g. birdies, pars, net score, or a specific hole outcome. Live Bets are agreed to and settled entirely between the proposer and acceptor. theStick only records and displays the agreed-upon outcome.
League pool events & Pick’em. League organizers may collect entry fees for pooled events and Pick’em contests and distribute payouts based on results calculated by the app. theStick does not collect, hold, or transmit these funds — all collection and payout occurs directly between the organizer and participants.
Peer-to-peer only. All wagering, buy-ins, and payouts described above — golf game bets, Live Bets, and league/Pick’em pools alike — are strictly between users. theStick does not act as a broker, escrow, intermediary, or payment processor. We assume no liability for any dispute between users regarding amounts owed or the outcome of any wager or contest.
No financial advice. Nothing in the Service constitutes financial, legal, or gambling advice.
theStick may offer free and paid subscription tiers. Paid subscriptions are billed in advance on a recurring basis and automatically renew unless cancelled.
Refunds. Subscription fees are generally non-refundable. If you believe you were charged in error, contact us at support@thestick.golf within 30 days.
Changes. We reserve the right to change pricing at any time with advance notice via email or in-app notification.
theStick may offer referral rewards when you invite friends who create accounts. Rewards are subject to terms displayed in the app and have no cash value. We reserve the right to modify or discontinue the program at any time.
Abuse of the referral program — including fake accounts or self-referrals — will result in forfeiture of all rewards and may result in account termination.
theStick allows you to link your GHIN number to display your official USGA Handicap Index. This data is fetched from the USGA GHIN system for informational convenience only and may not reflect real-time updates. For official handicap purposes, refer directly to your club or the USGA GHIN system.
You retain ownership of content you submit (scores, notes, photos). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and use that content to provide and improve the Service.
The theStick name, logo, and all app content (excluding user-submitted content) are the property of theStick, LLC and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Service without our prior written consent.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted or error-free. Score calculations and ledger totals are provided for convenience and may contain errors.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THESTICK, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING DISPUTES BETWEEN PLAYERS REGARDING WAGERS.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless theStick, LLC and its affiliates from any claims, damages, losses, and expenses (including attorneys’ fees) arising from your use of the Service, your violation of these Terms, or any dispute between you and another user.
You may delete your account at any time by contacting us at support@thestick.golf. We may suspend or terminate your account at any time if you violate these Terms, with or without notice.
These Terms are governed by the laws of the State of California. Disputes shall be resolved by binding arbitration in California under AAA rules. You waive any right to a jury trial or class action proceeding.
We may update these Terms from time to time with notice via email or in-app notification. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service.
